This means:

Lab Grown Diamonds

All diamonds sold through DiamondsByPost.com are lab grown diamonds, unless expressly stated otherwise in writing by us.

Lab grown diamonds are real diamonds created in a controlled laboratory environment. They are not natural mined diamonds.

By purchasing from us, you acknowledge and agree that:

1.          The diamonds sold through the website are lab grown diamonds.

2.          Lab grown diamonds are sold as luxury goods and diamond products.

3.          Lab grown diamonds are not sold as investment products.

4.          We do not guarantee future resale value.

5.          We do not guarantee appreciation in value.

6.          We do not guarantee any future market value.

7.          We do not provide financial, investment, resale or valuation advice.

8.          The market value of lab grown diamonds may rise, fall or change over time.

Consumer Use Only

DiamondsByPost.com is a consumer retail website.

By placing an order, you confirm that:

1.          You are purchasing as a consumer.

2.          You are not purchasing for wholesale resale.

3.          You are not purchasing as a trade buyer.

4.          You are not purchasing as a jeweller, dealer, reseller, distributor or commercial intermediary.

5.          You are legally capable of entering into a binding contract.

6.          You are at least 18 years old.

We reserve the right to refuse, cancel, suspend or investigate any order that appears to be commercial, wholesale, fraudulent, suspicious, high-risk, abusive, or inconsistent with the consumer purpose of the website.

Product Availability

This means:

2.          Availability is not guaranteed until confirmed by us.

3.          A diamond shown on the website may become unavailable before order acceptance.

4.          A diamond may be sold by a third-party supplier before we are able to secure it.

5.          Supplier stock feeds may be delayed, inaccurate or changed without notice.

6.          A product shown as available may later become unavailable.

7.          We are not responsible for third-party supplier availability changes.

No product listing on DiamondsByPost.com guarantees that the diamond is immediately available, reserved, secured, allocated or accepted for sale to you.

Prices

Product prices may be displayed in one or more currencies.

Prices may change due to:

2.          Exchange rate changes.

Order Process

An order placed through DiamondsByPost.com is an offer by you to purchase a product.

After you place an order, we may send an automatic acknowledgement. This acknowledgement does not mean the order has been accepted.

An order is only accepted when DiamondsByPost.com has:

1.          Confirmed diamond availability.

2.          Verified supplier confirmation.

3.          Verified payment.

4.          Completed fraud checks.

5.          Completed identity checks where required.

6.          Completed address checks where required.

7.          Completed anti-money laundering or compliance checks where required.

8.          Confirmed that the product can be supplied.

9.          Sent formal order acceptance to the customer.

Until formal order acceptance is issued by us, no binding sales contract exists.

We reserve the right to refuse or cancel any order before formal order acceptance.

Right to Refuse or Cancel Orders

We may refuse, cancel, delay, suspend or investigate any order where:

1.          The diamond is unavailable.

2.          The supplier cannot fulfil the order.

3.          The supplier changes the price.

4.          The website price is incorrect.

5.          Payment is not verified.

6.          Payment is reversed, disputed or suspected to be fraudulent.

7.          The order fails fraud checks.

8.          The customer fails identity verification.

9.          The customer fails to provide requested information.

10.      The billing and shipping information cannot be verified.

11.      The delivery address is considered high-risk.

12.      The order appears suspicious.

13.      The order appears to be for resale or trade use.

14.      The order may breach laws, sanctions, customs requirements or payment provider rules.

15.      We are unable to insure or safely ship the product.

16.      We are advised not to proceed by a bank, payment provider, courier, insurer, regulator, legal adviser or fraud prevention provider.

17.      Supply would be commercially unreasonable or impossible.

Where we cancel an order before acceptance, we will normally refund any payment received, unless funds are held, frozen, reversed, disputed, investigated or restricted by a bank, payment provider, law enforcement agency, regulator, court, or fraud prevention process.

Payment

We may accept payment through payment cards, bank transfer, payment links, online payment gateways, or other approved payment methods.

All payments must be made in cleared funds.

We reserve the right to:

1.          Refuse certain payment methods.

2.          Require bank transfer for high-value orders.

3.          Require payment from an account in the customer’s name.

6.          Delay order processing until payment has fully cleared.

Diamonds are high-value goods. To protect customers, payment providers, logistics partners, suppliers and our business, we reserve the right to conduct enhanced verification checks.

We may request:

2.          Emirates ID.

3.          National identity card.

4.          Driving licence.

5.          Proof of address.

6.          Bank transfer confirmation.

7.          Cardholder verification.

8.          Billing address verification.

9.          Delivery address verification.

10.      Telephone verification.

11.      Email verification.

12.      Video verification for high-value orders.

13.      Additional documents reasonably required for fraud prevention, anti-money laundering, payment security, customs, insurance, delivery or compliance.

We may refuse, cancel, delay or suspend an order if:

1.          You do not provide requested verification.

2.          Verification is incomplete.

3.          Verification is inconsistent.

4.          Verification appears false or suspicious.

5.          We cannot reasonably confirm the legitimacy of the transaction.

6.          We consider the order to be high-risk.

Anti-Money Laundering and Suspicious Activity

We are not required to disclose details of any fraud, compliance, anti-money laundering or security process where doing so may compromise security, violate legal obligations, or prejudice an investigation.

Diamond Certificates and Grading Reports

Diamonds sold through DiamondsByPost.com may be accompanied by third-party diamond grading reports, mainly from:

1.          IGI

2.          GIA

Other laboratories may be used where clearly stated.

Diamond grading reports are prepared by independent third-party laboratories. We do not control the grading standards, opinions, methods, tolerances or conclusions of any grading laboratory.

By purchasing a diamond, you acknowledge that:

1.          Diamond grading involves expert assessment.

2.          Different laboratories may grade diamonds differently.

3.          Colour, clarity, measurements, proportions, fluorescence, polish, symmetry and other characteristics may involve tolerances.

4.          A grading report is an expert opinion from the issuing laboratory.

5.          We are not liable for differences of opinion between laboratories, appraisers, valuers, jewellers, insurers or buyers.

6.          We are not responsible for any third-party laboratory changing, updating, withdrawing or revising a report.

Where a product is described by reference to a certificate, the certificate is the primary reference for the diamond’s stated characteristics.

Product Descriptions

We aim to provide accurate product information, but descriptions may be based on supplier data, certificate data, third-party inventory feeds and laboratory reports.

Product information may include:

1.          Carat weight.

2.          Colour grade.

3.          Clarity grade.

4.          Cut grade.

5.          Shape.

6.          Measurements.

7.          Polish.

8.          Symmetry.

9.          Fluorescence.

10.      Certificate number.

11.      Laboratory name.

12.      Images, videos or 360 views where available.

We are not responsible for minor discrepancies, supplier feed errors, typographical errors, data delays, image limitations, screen display differences, or subjective differences in appearance, provided the diamond substantially matches the relevant certificate or confirmed order details.

Images, Videos and Visual Appearance

Images, videos, renders, 360 views and visual representations are provided for guidance only.

The actual appearance of a diamond may vary due to:

1.          Screen settings.

2.          Device display differences.

3.          Lighting conditions.

4.          Magnification.

5.          Photography equipment.

6.          Video compression.

7.          Diamond proportions.

8.          Diamond cut style.

9.          Reflections.

10.      Viewing angle.

11.      Background colour.

12.      Natural differences between digital representation and physical inspection.

Images and videos may be enlarged to show detail. They may not represent actual size.

You should rely primarily on the diamond certificate, specifications and confirmed order details.

Order Cancellations by the Customer

Because loose lab grown diamonds may be sourced, secured, reserved, transported, insured and shipped from third-party suppliers in different countries, customer cancellations are restricted.

Once an order has been placed, we may begin supplier confirmation, diamond reservation, payment verification, fraud checks, logistics planning, insurance preparation and international transport arrangements.

Before Order Acceptance

If you request cancellation before formal order acceptance, we may agree to cancel at our discretion.

However, if costs have already been incurred, we reserve the right, where permitted by law, to deduct reasonable costs, administrative charges, supplier charges, currency costs, payment processing charges, banking fees, insurance fees, courier fees, restocking fees, and other direct costs incurred.

After Order Acceptance

After formal order acceptance, cancellation is not guaranteed.

If we agree to cancel after order acceptance, we reserve the right, where permitted by law, to deduct a cancellation, administration or restocking fee.

The cancellation, administration or restocking fee may be calculated at up to:

USD $50 per carat

This is intended to reflect sourcing, supplier handling, logistics, administrative work, opportunity cost, reservation risk, payment costs, currency costs and restocking impact.

If applicable law does not permit this charge in a particular case, the charge will apply only to the maximum extent permitted by law.

After Dispatch

Once the product has been dispatched, cancellation is not available. Any request will be treated under our returns process, if eligible.

Returns and Refunds

We operate a strict returns policy for loose lab grown diamonds.

A return may only be considered if all of the following conditions are satisfied:

1.          The customer contacts us within the permitted return period stated by us in writing.

2.          The return is approved by us before the diamond is sent back.

3.          The diamond is unused.

4.          The diamond is undamaged.

5.          The diamond has not been altered.

6.          The diamond has not been laser altered.

7.          The diamond has not been chipped, cracked, damaged or modified.

8.          The diamond has not been mounted into jewellery.

9.          The diamond has not been set into a ring, pendant, bracelet, necklace, earring or any other item.

10.      The diamond has not been handled in a way that reduces value.

11.      The original certificate is returned.

12.      Original packaging, security tags, seals and documentation are returned where applicable.

13.      The diamond passes inspection by us, our supplier, or an independent expert appointed by us.

14.      The certificate number and diamond identity match the original order.

15.      The customer complies with our return instructions.

We reserve the right to refuse a return if any of these conditions are not met.

Return Shipping, Insurance, Customs and Duties

Unless we expressly agree otherwise in writing, the customer is responsible for:

1.          Return shipping costs.

2.          Return insurance costs.

3.          Courier charges.

4.          Customs charges.

5.          Import duties.

6.          Export duties.

7.          Taxes.

8.          Brokerage fees.

9.          Clearance fees.

10.      Documentation fees.

11.      Any loss, delay, seizure, detention, damage or customs issue during return shipping.

Returned diamonds must be shipped using a secure, trackable and insured method approved by us.

The customer remains responsible for the diamond until it is physically received, inspected and accepted by us or our nominated receiving party.

We are not responsible for returned items that are lost, stolen, delayed, seized, damaged, misdelivered, underinsured, incorrectly declared, or returned without approval.

Refund Inspection

Refunds are not automatic upon return.

Any returned diamond must pass inspection.

Inspection may include:

1.          Verification of certificate number.

2.          Verification of inscription where applicable.

3.          Verification of carat weight.

4.          Verification of measurements.

5.          Verification of identity.

6.          Inspection for damage.

7.          Inspection for alteration.

8.          Inspection for setting marks.

9.          Inspection for chips, cracks or abrasions.

10.      Confirmation that the returned diamond is the same diamond supplied.

If the diamond fails inspection, we may refuse the refund and return the diamond to the customer at the customer’s cost, subject to payment of any applicable shipping, insurance, customs or administrative charges.

Refund Method and Timing

Approved refunds will normally be made to the original payment method unless we agree otherwise or are required to use another method.

Refund timing may depend on:

1.          Inspection completion.

2.          Supplier confirmation.

3.          Bank processing time.

4.          Payment provider processing time.

5.          Fraud checks.

6.          Chargeback checks.

7.          Currency conversion.

8.          Customs clearance.

9.          Legal or compliance reviews.

We are not responsible for delays caused by banks, card issuers, payment processors, customs authorities, courier companies or third-party providers.

Refunds may be reduced by any deductions permitted under these Terms & Conditions and applicable law.

Where mandatory consumer laws apply to a customer in a particular jurisdiction, those mandatory rights will apply only to the extent required by law.

Where legally permitted, our cancellation, return, inspection, restocking, customs, shipping, fraud prevention and refund conditions will apply.

Customers are responsible for understanding any local laws, customs rules, import restrictions, duties and taxes that apply in their country.

No Warranty on Loose Diamonds

DiamondsByPost.com sells loose lab grown diamonds only.

No product warranty is given or implied beyond any rights that cannot legally be excluded under applicable law.

For clarity:

1.          We do not provide a jewellery warranty.

2.          We do not provide a setting warranty.

3.          We do not provide a manufacturing warranty for jewellery.

4.          We do not warrant future value.

5.          We do not warrant resale price.

6.          We do not warrant investment performance.

7.          We do not warrant that a third-party valuer, jeweller, insurer, buyer or laboratory will agree with the original grading report.

8.          We do not warrant against damage after delivery.

9.          We do not warrant against loss, theft, misuse, mishandling, alteration, setting damage or attempted mounting by a third party.

Any unavoidable statutory rights remain unaffected.

International Shipping

We may offer international shipping to selected countries at our discretion.

We reserve the right to:

1.          Refuse shipment to certain countries.

2.          Refuse shipment to high-risk destinations.

3.          Refuse shipment where insurance is unavailable.

4.          Refuse shipment where customs clearance is uncertain.

5.          Refuse shipment where delivery security is insufficient.

6.          Require delivery to the billing address.

7.          Require delivery to a verified address.

8.          Require identity verification before dispatch.

9.          Use a courier of our choice.

10.      Delay shipment for payment, fraud, customs, insurance or compliance reasons.

Customs, Duties, Taxes and Import Responsibility

International customers are responsible for all customs, import, tax and clearance obligations in their destination country.

Unless expressly stated otherwise in writing, product prices do not include:

1.          Import duties.

3.          Local VAT.

4.          Local GST.

5.          Sales tax.

6.          Brokerage fees.

7.          Clearance fees.

If the customer refuses delivery, fails to pay customs charges, fails to provide required documents, or causes the package to be returned, rejected, delayed, seized or abandoned, we reserve the right to deduct all resulting costs from any refund, where permitted by law.

Such costs may include shipping, return shipping, insurance, customs, duties, taxes, storage fees, supplier charges, restocking fees, administrative costs and loss in value.

Delivery and Risk

Risk passes to the customer when the courier records delivery to the delivery address provided by the customer.

Delivery may include delivery to:

1.          The customer personally.

2.          A person at the delivery address.

3.          A concierge.

4.          A reception desk.

5.          Building security.

6.          A nominated recipient.

7.          A courier-approved collection point.

8.          Any person or location accepted by the courier as successful delivery.

Once delivery is confirmed by the courier, we are not responsible for loss, theft, misplacement, unauthorised access, building handling, concierge handling, reception handling, security desk handling, or failure by the customer to collect the package promptly.

The customer must ensure that the delivery address is secure, accurate and suitable for receiving high-value goods.

Incorrect Delivery Information

The customer is responsible for providing complete and accurate delivery information.

We are not responsible for loss, delay, failed delivery, additional charges, customs issues, returned parcels, or delivery to the wrong address caused by inaccurate, incomplete or outdated information provided by the customer.

If a package must be redirected, returned, re-shipped or reprocessed due to customer error, the customer is responsible for all related costs.

Failed Delivery and Refused Delivery

If delivery fails because the customer is unavailable, refuses delivery, provides incorrect information, fails courier verification, fails to pay customs charges, fails to respond to courier requests, or fails to collect the parcel, we may deduct all resulting costs from any refund where permitted by law.

These costs may include:

1.          Initial shipping.

2.          Return shipping.

3.          Insurance.

4.          Courier fees.

5.          Customs charges.

6.          Import duties.

7.          Export charges.

8.          Storage charges.

9.          Supplier charges.

10.      Administrative costs.

11.      Restocking fees.

12.      Payment processing costs.

13.      Currency exchange losses.

Lost, Damaged or Delayed Shipments

If a shipment is lost, damaged or delayed before courier-confirmed delivery, we will work with the courier, insurer and relevant parties to investigate.

The customer must cooperate with any investigation, including providing documents, declarations, signatures, identity confirmation or non-receipt statements.

We are not required to refund or replace a product until the courier, insurer or investigation process confirms the outcome.

Where the courier confirms delivery, the shipment will normally be treated as delivered unless clear evidence proves otherwise.

Sanctions, Restricted Countries and Legal Compliance

We reserve the right to refuse, cancel, delay or block any order where we believe that fulfilling the order may breach sanctions, export restrictions, import restrictions, anti-money laundering obligations, customs rules, courier rules, payment provider rules, insurance requirements, or applicable law.

We are not liable for refusal, cancellation, delay, non-delivery or refund delay caused by legal, regulatory, sanctions, compliance or risk requirements.

Customer Responsibilities
