This Cancellation Policy explains how cancellation requests are handled for orders placed through DiamondsByPost.com.

DiamondsByPost.com is owned and operated by Amit Verma Jewellery LLC, based in Dubai, United Arab Emirates.

DiamondsByPost.com sells loose lab grown diamonds only. We do not sell jewellery, mounted diamonds, engagement rings, wedding rings, bespoke jewellery, custom jewellery, or wholesale products through this website.

Because our diamonds are supplied through third-party supplier stock and may be sourced, reserved, transported, insured, and shipped internationally, cancellations are restricted and may involve costs once an order has been placed.

By placing an order on DiamondsByPost.com, you agree to this Cancellation Policy.

Order Placement Does Not Mean Order Acceptance

When a customer places an order through DiamondsByPost.com, the order is treated as an offer to purchase.

An order is not accepted immediately when payment is made or when an automated email is received.

An order is only accepted once DiamondsByPost.com has:

  1. Confirmed diamond availability.

  2. Confirmed supplier availability.

  3. Verified the price.

  4. Verified payment.

  5. Completed fraud checks.

  6. Completed identity checks where required.

  7. Completed address checks where required.

  8. Confirmed the order can be fulfilled.

  9. Sent formal order acceptance to the customer.

Until formal order acceptance has been issued, no binding sales contract exists.

Why Cancellation Rights Are Restricted

Loose lab grown diamonds listed on DiamondsByPost.com are generally sourced from third-party supplier stock.

Once an order is placed, we may begin work immediately, including:

  1. Checking supplier availability.

  2. Reserving the diamond.

  3. Securing the diamond from the supplier.

  4. Preparing payment confirmation.

  5. Conducting fraud and compliance checks.

  6. Arranging insured shipping.

  7. Coordinating international transport.

  8. Preparing export or customs documentation.

  9. Allocating internal administrative time.

  10. Removing or restricting the diamond from wider availability.

As a result, cancellation may not always be possible without cost.

Customer Cancellation Before Formal Order Acceptance

If a customer requests cancellation before formal order acceptance has been issued, DiamondsByPost.com may agree to cancel the order at its discretion.

Where no supplier, payment, banking, administrative, currency, courier, insurance, or processing costs have been incurred, we may issue a full refund.

However, if costs have already been incurred, we reserve the right, where permitted by law, to deduct reasonable costs before issuing any refund.

These costs may include:

  1. Supplier reservation charges.

  2. Supplier cancellation charges.

  3. Payment processing fees.

  4. Banking charges.

  5. Currency conversion losses.

  6. Administrative costs.

  7. Insurance preparation fees.

  8. Courier booking fees.

  9. Compliance and verification costs.

  10. Any other reasonable costs already incurred in connection with the order.

Customer Cancellation After Formal Order Acceptance

Once formal order acceptance has been issued, cancellation is not guaranteed.

After order acceptance, the diamond may already have been secured, reserved, paid for, transferred, transported, or prepared for dispatch.

If DiamondsByPost.com agrees to allow cancellation after formal order acceptance, we reserve the right to charge a cancellation fee of up to 15% of the order value, plus any third-party costs already incurred including:

  1. Supplier handling.

  2. Supplier restocking.

  3. Administrative time.

  4. Payment processing.

  5. Banking costs.

  6. Currency exchange losses.

  7. Diamond reservation costs.

  8. Courier preparation.

  9. Insurance preparation.

  10. Compliance checks.

  11. Internal order processing.

  12. Opportunity cost caused by removing or reserving the diamond.

If applicable law does not permit this fee in a particular case, the fee will apply only to the maximum extent permitted by law.

Cancellation After Dispatch

Once a diamond has been dispatched, the order cannot be cancelled.

Any customer request after dispatch will be handled under our Returns & Refunds Policy, if the diamond is eligible for return.

For clarity:

  1. Dispatch may include release from the supplier.

  2. Dispatch may include transfer to a courier.

  3. Dispatch may include movement to an export hub.

  4. Dispatch may include movement to DiamondsByPost.com or its nominated logistics partner.

  5. Dispatch may include international transit.

Once the diamond has entered the shipping or logistics process, cancellation is no longer available.

Non-Cancellable Situations

DiamondsByPost.com may refuse a cancellation where:

  1. The diamond has been secured from the supplier.

  2. The diamond has already been paid for by us.

  3. The diamond has been prepared for dispatch.

  4. The diamond has entered courier or logistics handling.

  5. The diamond has been shipped internationally.

  6. Customs or export documentation has been prepared.

  7. Supplier cancellation is not permitted.

  8. Supplier price has changed and we have chosen not to proceed.

  9. The order has passed acceptance.

  10. The cancellation request appears fraudulent, or commercially unreasonable.

  11. The customer has failed verification after causing costs to be incurred.

  12. The customer is attempting to cancel after movement in the market.

Cancellation by DiamondsByPost.com

DiamondsByPost.com reserves the right to cancel an order at any time before fulfilment where necessary or reasonable.

Reasons may include:

  1. The diamond becomes unavailable from the supplier.

  2. The supplier changes the price.

  3. Payment cannot be verified.

  4. Fraud checks are not passed.

  5. Identity verification is not completed.

  6. Address verification is not completed.

  7. The delivery address is considered high risk.

  8. Insured shipping is unavailable.

  9. Customs clearance appears unsuitable or high risk.

  10. The order may breach sanctions, laws, payment rules, courier rules, insurance rules, or compliance requirements.

  11. The customer provides inaccurate or incomplete information.

  12. The customer fails to respond to reasonable requests.

  13. Fulfilment would be commercially unreasonable, unsafe, unlawful, or impractical.

Where DiamondsByPost.com cancels an order before fulfilment, we will normally refund any payment received, subject to any lawful deductions and subject to funds not being frozen, reversed, withheld, disputed, or restricted by a payment provider, bank, regulator, court, law enforcement agency, or fraud prevention process.

Pricing Errors and Supplier Price Changes

DiamondsByPost.com relies on third-party supplier stock and supplier data.

Prices may change because of:

  1. Supplier price movement.

  2. Market movement.

  3. Exchange rate changes.

  4. Feed errors.

  5. Currency conversion errors.

  6. Data errors.

  7. Website errors.

  8. Human errors.

  9. Technical faults.

  10. Stock availability changes.

If a diamond is listed at an incorrect price, or if the supplier changes the price before order acceptance, DiamondsByPost.com reserves the right to cancel the order, correct the price, request payment of the correct price, offer an alternative diamond, or issue a refund.

We are not required to honour incorrect prices caused by error.

Refunds After Cancellation

Where a cancellation is approved and a refund is due, refunds will normally be made to the original payment method.

Refunds may be reduced by lawful deductions, including:

  1. Supplier charges.

  2. Restocking fees.

  3. Administration fees.

  4. Payment processing fees.

  5. Banking charges.

  6. Currency conversion losses.

  7. Courier costs.

  8. Insurance costs.

  9. Customs costs.

  10. Any other reasonable costs already incurred.

Refund timing may depend on:

  1. Bank processing times.

  2. Payment gateway processing times.

  3. Card issuer processing times.

  4. Fraud checks.

  5. Compliance checks.

  6. Chargeback reviews.

  7. Currency processing.

  8. Supplier confirmation.

  9. Internal review.

DiamondsByPost.com is not responsible for delays caused by banks, card issuers, payment processors, payment gateways, or financial institutions.

Customer Failure to Complete Verification

If a customer places an order but fails to complete required verification, we may cancel the order.

Verification may include:

  1. Identity verification.

  2. Proof of address.

  3. Payment verification.

  4. Cardholder verification.

  5. Telephone verification.

  6. Email verification.

  7. Video verification for high-value orders.

  8. Any other reasonable anti-fraud, compliance, payment, shipping, or security checks.

Customer Failure to Provide Accurate Information

If a customer provides incorrect, incomplete, false, outdated, or inconsistent information, we may cancel, delay, suspend, or investigate the order.

This includes incorrect or incomplete:

  1. Name.

  2. Billing address.

  3. Shipping address.

  4. Email address.

  5. Telephone number.

  6. Payment information.

  7. Identity information.

  8. Customs information.

  9. Verification documents.

Where inaccurate information causes costs, delay, cancellation, failed shipping, customs issues, or supplier charges, the customer may be responsible for those costs where permitted by law.

No Automatic Right to Cancel After Payment

Payment does not create an automatic right to cancel.

Payment also does not mean that:

  1. The diamond has been secured.

  2. The diamond is available.

  3. The order has been accepted.

  4. The price has been finally confirmed.

  5. The diamond has been allocated to the customer.

  6. Shipping has been approved.

  7. Fraud checks have been passed.

An order is only accepted after formal order acceptance is issued by DiamondsByPost.com.

Chargebacks and Payment Disputes

Customers must contact support@diamondsbypost.com before raising a chargeback or payment dispute.

If a chargeback or dispute is raised, we may:

  1. Suspend the order.

  2. Cancel the order.

  3. Delay fulfilment.

  4. Provide evidence to the payment provider.

  5. Recover costs.

  6. Recover chargeback fees.

  7. Recover administrative costs.

  8. Block future purchases.

  9. Report suspected fraud where appropriate.

  10. Take legal action where necessary.

Raising a chargeback does not automatically cancel the order or remove the customer's responsibility for costs already incurred.

Statutory Consumer Rights

Nothing in this Cancellation Policy is intended to exclude or limit any consumer rights that cannot legally be excluded or limited.

Where mandatory consumer laws apply to a customer in a particular jurisdiction, those rights will apply only to the extent required by law.

Where legally permitted, the cancellation restrictions, administrative charges, restocking fees, supplier costs, shipping costs, payment costs, customs costs, inspection requirements, and refund deductions in this Cancellation Policy will apply.

Force Majeure and Events Outside Our Control

DiamondsByPost.com is not liable for cancellation, delay, failure to fulfil, or changes caused by events outside our reasonable control.

This may include:

  2. Supplier cancellation.

  3. Courier failure.

  4. Customs delays.

  5. Border restrictions.

  6. Government action.

  7. War.

  8. Civil unrest.

  9. Sanctions.

  10. Natural disasters.

  11. Fire.

  12. Flood.

  13. Pandemic.

  14. Epidemic.

  15. Payment gateway failure.

  16. Banking failure.

  17. Cyberattack.

  18. System failure.

  19. Website feed failure.

  20. Currency disruption.

  21. Airline disruption.

  22. Import or export restriction.

Where such an event affects an order, we may cancel, delay, suspend, or modify fulfilment without liability, subject to any mandatory legal rights.

Relationship With Other Policies
